The terms “You” and “User” as used herein refer to all individuals and/or entities accessing this web site for any reason. Neither Bert Rodgers, nor any providers of information make any warranties, express or implied, as to results to be obtained from use of such information, and make no express or implied warranties of merchantability or fitness for a particular purpose or use. Neither Bert Rodgers nor any of providers of information shall have any liability for the accuracy of the information contained in the service, or the contents of any advertisements, or for assertions or omissions therein. CONDITIONS OF USE
Bert Rodgers Sites may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees. You are entirely responsible and liable for all postings to the Bert Rodgers site. Listed below are some, though not all, violations which may result in Bert Rodgers deleting your postings. You agree not to do any of the following actions while posting an ad to the Bert Rodgers site:

Harass, threaten, embarrass or slander any person or entity;

Make any untrue or false claims in any ad posting;
Transmit via Bert Rodgers any information, data, text, files, links, software, chat, communication or other materials (“Content”) that Bert Rodgers considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, profane, obscene, hateful, racially, ethnically or otherwise objectionable;

Impersonate any business, person, or entity, living or dead, famous or not;

Intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing the Bert Rodgers site or in connection with your use of the Bert Rodgers site in any manner.

Posting any incomplete, false or inaccurate biographical information or information which is not your own accurate resume (living individual seeking employment on a full-time or part-time basis on his or her own behalf).

Posting any franchise, pyramid scheme, multi-level marketing, “club me mb ership”, distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, requires recruitment of other me mb ers, sub-distributors or sub-agents, unless a valid real estate, mortgage broker, or insurance license is required for said opportunity.

Sending unsolicited mail or e-mail, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a user of a Bert Rodgers Site.

Deleting or revising any material posted by any other person or entity.

Using any device, software or routine to interfere or attempt to interfere with the proper working of any Bert Rodgers Site or any activity being conducted on this site.
Taking any action which imposes an unreasonable or disproportionately large load on any Bert Rodgers Site’s infrastructure.

INTELLECTUAL PROPERTY

The Company acts as a passive conduit for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not conform to these Terms and Conditions, the Company may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. The Company has no liability or responsibility to users for performance or nonperformance of such activities. The Company reserves the right to expel users and prevent their further access to the Web Site for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal, or disruptive. The Company may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISPs or other suppliers.

Any hyperlinks, “hidden” keywords or any keywords that are irrelevant to the job or are otherwise misleading contained in a job posting are prohibited.
You must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. Bert Rodgers shall not be responsible for any Content. Bert Rodgers may or may not prescreen or monitor Content as a matter of policy. Bert Rodgers shall have the right, but not the responsibility, to remove Content which is deemed in Bert Rodgers’s sole discretion, harmful, offensive, or otherwise in violation of this Agreement or any rules Bert Rodgers has in place at the time. Bert Rodgers may elect at its sole discretion to monitor some, all, or no areas of Bert Rodgers’s site for adherence to this Agreement or rules.

DISCLAIMER OF WARRANTIES
bertrodgers.com is only a venue. This Web Site acts as a venue for employers to post job opportunities and candidates to post resumes and does not screen or censor the listings offered. The Company is not involved in the actual transaction between employers and candidates. As a result, the Company has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through the Web Site and/or the other Bert Rodgers Sites.

Because user authentication on the Internet is difficult, the Company cannot and does not confirm that each user is who they claim to be. Indemnity.
